These terms govern your use of summitcapitaldirect.com, operated by Seasharp LLC, a Connecticut limited liability company doing business as Summit Capital Direct. By using this site or submitting a loan request, you agree to these terms. If you do not agree, do not use the site.

What we are, and what we are not

Summit Capital Direct is a loan matching service. We are not a lender, and we are not an agent, representative, or broker of any lender. We do not make loans, make credit decisions, set rates or terms, or handle loan funds. When you submit a request, we share it with lenders and lending networks so they can decide whether to make you an offer. Every rate, fee, term, and approval decision comes from the lender, not from us.

Lenders and lending networks pay us when we connect them with consumers. That compensation may affect which lenders receive your request and in what order. You never pay us anything.

Where the service is available

Summit Capital Direct is not available to residents of Connecticut, New Hampshire, or Vermont. We may add or remove states at any time. If you reside in a state where the service is not available, you may not submit a request.

Who can use the service

You must be at least 18 years old, a resident of the United States, and using the service for yourself. You agree to provide accurate, current, and complete information in your request. Submitting information about another person without their authorization is prohibited.

How the service works

You fill out a loan request form. We validate the information you provide, then transmit your request to lenders and lending networks in our marketplace. Interested lenders may contact you directly with offers. Reviewing, accepting, or declining an offer happens between you and the lender under the lender's own terms, applications, and agreements. Submitting a request through this site is not a loan application and does not guarantee that you will receive an offer, an approval, or any particular rate or term.

Consent to be contacted

When you submit a request, you agree to the consent language presented with the submit button, which authorizes lenders and their partners to contact you at the phone number and email you provided, including through automated technology. That consent is not a condition of any loan approval or purchase. You can revoke consent with a specific lender by following their opt-out instructions, and you can tell us to stop sharing your information as described in our Privacy Policy.

Electronic communications

By using the site you consent to receive communications from us electronically, including email, and you agree that notices, disclosures, and records we provide electronically satisfy any requirement that they be in writing. You may request a paper copy of any record we hold about your request by emailing us.

Credit inquiries

We do not pull your credit. When you submit a request, you authorize lenders who receive it to obtain consumer reports about you from consumer reporting agencies or alternative providers to evaluate your request, as stated in the consent language presented with the submit button. A lender's initial review is typically a soft inquiry, which does not affect your credit score. If you proceed with a lender's full application, that lender may perform a hard inquiry, which can affect your score. Each lender's process is disclosed by that lender.

Third party lenders

Lenders in our marketplace are independent businesses. We do not control and are not responsible for their offers, decisions, conduct, websites, or compliance with the agreements they make with you. Your relationship with any lender is governed by that lender's terms and privacy policy.

Acceptable use

You agree not to submit false or fraudulent information, interfere with the operation of the site, attempt to access systems or data not intended for you, scrape or harvest data, or use the site for any unlawful purpose. We may refuse, decline, or discard any request at our discretion, including requests that fail our validation checks.

Intellectual property

The site, including its text, design, logos, and software, belongs to Seasharp LLC or its licensors. You may use the site for your personal, non-commercial use. No other rights are granted.

Disclaimers

The site and the service are provided as is and as available, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error free, that you will receive loan offers, or that any offer will meet your needs.

Limitation of liability

To the fullest extent permitted by law, Seasharp LLC and its members, officers, and employees will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the site or the service. To the fullest extent permitted by law, our total liability for any claim arising from the site or the service will not exceed one hundred dollars. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless Seasharp LLC from claims, losses, and expenses, including reasonable attorney fees, arising from your violation of these terms or your misuse of the service.

Governing law and disputes

These terms are governed by the laws of the State of Connecticut, without regard to its conflict of laws rules. Any dispute arising from these terms or the service will be brought in the state or federal courts located in Connecticut, and you consent to their jurisdiction. Nothing in this section limits rights you may have under the consumer protection laws of your state of residence.

Changes to these terms

We may update these terms from time to time. The date at the top reflects the latest version. Material changes apply to requests submitted after the change takes effect. Continued use of the site after a change means you accept the updated terms.
